Bajo las regulaciones del capítulo 16 del Tratado de Libre Comercio para América del Norte (NAFTA por sus siglas en inglés) los ciudadanos de Canadá, los Estados Unidos y México pueden ingresar de manera fácil y expedita a cualquiera de esos países para llevar a cabo actividades de negocios o inversiones.

 

A todas las personas que lleven a cabo actividades de negocios y que se beneficien de las provisiones de NAFTA no se les pedirá el tener que obtener primero una opinión favorable por parte del Departamento de Recursos Humanos y Desarrollo Social de Canadá, HRSDCpara permitir el acceso a un ciudadano de México o de los Estados Unidos al mercado laboral de Canadá. EL TLCAN aplica para cuatro categorías específicas comerciales: hombres de negocios, profesionistas, empleados que se estén cambiando a una de las filiales donde la compañía tenga presencia, intra-company transferes, y personas que realicen actividades de negocios, todos ellos pueden ingresar a Canadá sin que se tenga que realizar una opinión favorable por parte de Service Canada o HRSDC.

 

UN VISITANTE DE NEGOCIOS:

 

I. Debe de ingresar a Canadá para tomar parte en actividades tales como investigación técnica o científica, para acudir a algún tipo de evento o exposición, para la venta de productos o servicios (pero sin entregar tal producto o servicio en ese momento, sino posteriormente) y servicios después de la venta.

 

II. La persona no debe de intentar entrar al mercado laboral canadiense, en otras palabras, la principal fuente de remuneración para el trabajador proviene del extranjero y no se produce en Canadá; y

 

III. No requiere un permiso temporal de empleo.

 

UN PROFESIONAL:

 

I. Debe de calificar para trabajar en cualquiera de las más de 60 ocupaciones a las que hace referencia el Apéndice 1603.D.1 del Capítulo 16 de NAFTA. Estas ocupaciones son las siguientes:

PROFESIONISTA DE UNA FILIAL DE UNA EMPRESA QUE TENGA SU OPERACIÓN PRINCIPAL EN CUALQUIERA DE LOS OTROS DOS PAISES:

 

I. Debe de haber trabajado por lo menos un año durante los últimos tres años para un empleador Mexicano o Estadounidense el cual intenta hacer la transferencia del profesionista;

II. Debe de ser transferido a Canadá para trabajar temporalmente para el mismo o un empleador afiliado;

III. Trabaja exclusivamente a nivel ejecutivo o administrativo, o cuenta con conocimientos especializados; y

IV. Requiere de un permiso de trabajo

 

COMERCIANTE O INVERSIONISTA:

 

I. Es una persona que lleva a cabo comercio de manera sustancial en bienes o servicios principalmente entre Canadá y el país de ciudadanía de esta persona, o es un individuo llevando a cabo inversiones sustanciales en Canadá, en un papel de ejecutivo o de supervisión, o en un papel en donde se exigen habilidades esenciales;

II. Cumple los requisitos adicionales de NAFTA; y

III. Requiere de un permiso temporal de trabajo.

 

Cabe mencionar que NAFTA no da por si sola la oportunidad de lograr la residencia permanente a ciudadanos mexicanos. No obstante, el trabajar en Canadá legalmente por más de un año le dará puntaje adicional que le ayudará a conseguir la residencia permanente para usted y su familia. Asimismo, el trámite migratorio es mucho más corto ya que en estos casos, si continua trabajando en Canadá, el proceso se realiza en Buffalo Nueva York, donde los procesos son más rápidos que en su país de origen.
